Under Rule 57 of the Trade Marks Rules, 2017, a renewal application may be filed at any time not more than one year before the expiration of the last registration.

Late Renewal & Trademark Restoration
Missing the expiry date does not mean you should stop at the first hurdle. The Trade Marks Act and Rules provide specific mechanisms involving surcharge and, in certain circumstances, restoration and renewal.
Within 6 Months After Expiry
Section 25(3) provides for renewal on application in the prescribed form with the prescribed fee and surcharge within six months from expiration.
After 6 Months
If the mark has been removed for non-payment, Section 25(4) provides a restoration and renewal route after six months and within one year from the expiration of the last registration, subject to the prescribed requirements.
